Kenyon successfully represented Iovate Health Sciences Research, Inc., a leading nutritional supplement company, in a false advertising and antitrust lawsuit brought by a competitor, Wellnx Life Sciences, Inc. The suit, filed in September 2006 by Wellnx (formerly known as NxCare, Inc.) against Iovate, alleged that the Iovate had violated § 43(a) of the Lanham Act by engaging in false and misleading advertising practices. Judge Kevin Castel of the US District Court for the Southern District of New York, dismissed the entire lawsuit under Rule 12(b)(6) of the Federal Rules of Civil Procedure.
