Press Release
New York, NY - May 27, 2008
Kenyon & Kenyon Partner,
Michelle Mancino Marsh, was featured in Managing Intellectual Property's "10 To Watch - The Cases Shaping Trade Mark Litigation" May issue. She has represented Punchgini, the owner of New York's Bukhara Grill restaurants against Indian conglomerate ITC through the US court system since 2003 and prevailed on all counts. ITC had accused Punchgini of adopting the name of its New Delhi restaurant, Bukhara, and sued Punchgini for trade mark infringement and unfair competition under Federal and New York state law.
ITC Limited v Punchgini is written up as one of the top ten trademark cases in the world currently shaping trademark litigation. The article highlights the cases that "deal with cutting-edge legal issues that are shaping the way that the courts handle trade mark disputes. As such, they are cases that IP owners, and their advisers, need to understand."
