New York, August 28, 2009 - The Trademark Trial and Appeal Board last week ruled in favor of Kenyon & Kenyon LLP clients DC Comics and Marvel Characters, Inc., and entered Summary Judgment against Michael Silver in his attempt to register the mark SUPERHERO for skin care products. DC Comics and Marvel Characters, Inc. established that Silver lacked a bona fide intent to use the mark at the time he filed his application, and the Board therefore sustained the Opposition.
