Acting on behalf of the defendants in Zimmer v. CooperNeff Advisors, Inc., Kenyon negotiated a highly favorable settlement for CooperNeff Advisors, Inc. after two days of arbitration hearings. The case involved claims of copyright infringement, misappropriation of trade secrets, breach of contract, and defamation regarding a software platform used for daily trades made by a multimillion dollar hedge fund, with damages alleged to exceed $10 million.
CooperNeff Advisors was represented in the case by Kenyon attorneys Cy Walker, Brian Mudge and Brett Watkins. The company is a U.S. subsidiary of BNP Paribas, one of the largest French banks.
In prior phases of the case, the Kenyon team, led by Ed Colbert, defeated a motion for preliminary injunction and successfully moved the case from federal court to arbitration, winning reversal at the Third Circuit of the district court's prior denial of arbitration.
