It is always a challenge to attempt a ‘global overview’ of developments in trademark law. While organisations such as the World Intellectual Property Organization (WIPO), and the International Trademark Association (INTA) continue to play strong leadership roles in advancing the interests of trademark owners and increased harmonisation of laws and regulations related to trademarks, the fact remains that trademarks for the most part are still subject to country-by-country (or in some cases larger jurisdiction-by-jurisdiction) development and enforcement mechanisms, and wide disparities still exist between the overall substantive rights available to trademark owners, grounds for protections and remedies for violations of such rights.
